Texas policyholders just gained a powerful new protection. In 2025, the Texas Legislature passed Senate Bill 458 (SB 458), landmark legislation that requires all personal auto and residential property insurance carriers to include a mandatory appraisal clause in their policies — restoring a consumer right that had quietly been stripped away by major insurers over the past decade.
The appraisal clause is a form of alternative dispute resolution. When a policyholder and their insurance company cannot agree on the amount of a covered loss — whether from a vehicle collision, hail damage, or a home claim — either party can invoke the appraisal process to bring in independent professionals to determine the true cost of damages. Each side appoints their own appraiser. If those appraisers cannot reach an agreement, a neutral umpire is selected to make the final, binding decision. Critically, this process addresses the amount of loss, not whether coverage exists.
The need for this law stems from a troubling trend. Beginning in 2015, major carriers — including some of the largest auto insurers in the nation — began quietly filing requests with the Texas Department of Insurance (TDI) to remove the appraisal clause from their policies. Without a clear statutory mandate, regulators had limited authority to stop them. The result: thousands of Texas policyholders were left with no neutral recourse when they disputed their carrier’s damage valuation. Their only options were to accept a lowball offer or file a lawsuit.
SB 458 changes that permanently. The law took effect September 1, 2025, and applies to all policies issued or renewed on or after January 1, 2026. Texas Department of Insurance The Texas Department of Insurance now has express rulemaking authority to set standards for the appraisal process, including appraiser qualifications, timelines, and umpire selection. Texas Capitol The appraisal award is binding except in cases of fraud, material mistake, or where the award exceeds the appraiser’s authority.
